When it comes to answering the question of whether or not I think Jane should be held liable is a little complex in a way. In the scenario presented to me I would definitely have to say that I think Jane should be held liable for the fireman's death. I think this because when we look at the topics of causation and But-For, The fire man wouldn't have died at that time if it wasn't for Janes actions. Although Jane did not directly mean to kill the fireman her actions of lighting her business on fire caused the events and conditions that would lead to the fireman's death. So in that sense I belle that she is responsible for the death. I believe that here actions would count as causation in this scenario because her actions directly lead to the conditions that caused the fireman's death.
You can also look at Jane's actions and align them with means rea, it can be seen that she acted with criminal intent and knew the dangers of it. And she then followed through with her thoughts and committed the criminal act. It seems pretty clear that she wanted to commit a criminal act. In the scenario she committed arson a Felony, because she intended to defraud someone with the arson. But she also intended to commit insurance fruad another felony. And because her illegal actions led to the death of a first responder who she would reasonably know would respond to the fire she should be held liable.
When it comes to thinking of other concepts that can be applied to this situations I can think of is proximate causation. Jane in this situation would have reasonably known that her actions of committing criminal acts and lighting the fire would have been inherently dangerous. And very very likely involved first responders coming to the fire. She also would have reasonably known that her lighting of the fore created a very dangerous situation for when first responders arrive and they could very likely be seriously harmed. When you follow all these events looking at it in this way you can see a clear chain of events the led to the fireman's death that were all directly cause by Jane and her actions.
