Writing Question

Overview

PART 1 COMPLETE DISCUSSION

There are three theories of discrimination: disparate treatment, mixed motive, and disparate impact.

  • Discuss one of the theories and a case that used this theory as a basis for the decision. In your response, consider solutions to mitigate discrimination. For example, how might artificial intelligence support endeavors to resolve discrimination issues?
  • Please also consider how certain laws have evolved to cover types of discrimination and protected classes that were not contemplated at the time the laws were passed. What does that teach you about the evolution of laws to match the current state of affairs?

PART 2 REPLY TO DISCUSSION

One theory of discrimination is disparate treatment, which means intentionally treating someone differently because of a protected characteristic like race or gender. The Equal Employment Opportunity Commission explains that this occurs when an employee is treated less because of these traits (EEOC, n.d.).

A key case is Young v. United Parcel Service, where a pregnant employee was denied accommodations given to others. The Court ruled this could be discrimination if similar employees were treated differently without a valid reason (U.S. Supreme Court, 2015).

To reduce discrimination, companies can use AI to make hiring decisions more consistent, but they must monitor it to avoid bias. Over time, laws have expanded to include more protected groups, showing that laws evolve to keep up with society and new challenges.

PART 3 REPLY TO DISCUSSION

Disparate impact happens when a rule or policy seems fair on the surface, but actually ends up hurting some groups more than others even if that wasn’t the intention. Take the Griggs v. Duke Power Company case, for example. The company required workers to pass a test or have a diploma to qualify for better jobs. But not everyone, especially African American employees, had the same access to education, so these rules kept them from moving up. The court decided this was unfair. To avoid problems like this, companies sometimes use artificial intelligence to review their hiring and promotion practices. AI can help spot trends where certain groups might not be treated equally, giving companies a chance to fix things. Of course, it’s also important to make sure the AI itself isn’t biased. Over the years, discrimination laws have expanded to protect more people. At first, they focused on certain groups, but now they also cover people with disabilities and those of different sexual orientations. This shows that laws need to keep up with changes in society, so everyone gets a fair chance.
