Final Research Assignment Week #4

Scenario:

You are a project manager for Greenbuild, Inc., a mid-sized construction firm specializing in commercial and industrial projects. Your company has been approached by EcoEnergy Corporation to build a state-of-the-art solar panel manufacturing facility. The project has the following characteristics:

- Location: A brownfield site in west Boca Raton, FL with potential soil contamination

- Estimated budget: $50 million

- Desired completion time: 18 months

- Key features:

* 100,000 sq ft main manufacturing building

* 20,000 sq ft research and development center

* 50-acre solar farm for on-site power generation

* Specialized clean room environments

* Advanced robotic assembly lines

EcoEnergy has expressed concerns about cost overruns due to the specialized nature of the facility and potential site remediation needs. They also want to ensure the project can be completed quickly to meet market demands.

Assignment Tasks:

1. Contract Selection (15 points)

Describe the process for managing this change order, including necessary documentation, potential impacts on schedule and budget, and how you would negotiate terms with the client.

7. Dispute Resolution and Risk Management (30 points)

b) Warranties and Latent Defects: Six months after project completion, issues arise with the clean room environmental controls. Discuss how warranties would apply and the concept of latent defects in this situation.

c) Force Majeure: A severe earthquake damages the partially completed facility. Explain how a force majeure clause might apply and the steps you would take to address this situation.

d) Site Conditions: During excavation, previously unknown soil contamination is discovered, requiring extensive remediation. Discuss how this relates to site condition clauses and potential dispute resolution approaches.

e) Owner's Right to Inspect: EcoEnergy frequently sends representatives to inspect the work, causing delays and disruptions. How would you manage this situation while respecting the owner's rights and maintaining project progress?
