PART 1) Using the cases Rowley and Endrew students will:
- Discuss how the U.S. Supreme Court has defined the two prongs of an “appropriate education”
- Analyze what is the actual substantive “educational progress” that FAPE promises. Is it a promise of substantive progress or an opportunity to make substantive progress? How do you know? What is the difference and why does it matter?
PART 2) Using the legal tests offered in Daniel RR, Oberti, and Rachel H. students will: Evaluate which legal tests best serve (a) students with disabilities, (b) local school agencies, and (c) the intent of IDEA.
