Discussion- Duty
Please read the following case study and answer the questions posted after the case study. Please support your answers with two references and cite these references in your post.
I. Event Narrative
Upon arriving at Green Hills Medical Center for a scheduled evening shift, Bob (PCT) encountered an unusual auditory event: the sharp screeching of tires followed by the rapid acceleration of a vehicle. From his vantage point, Bob observed only the receding taillights of a car as it turned a corner. Despite the suspicious nature of the sounds, Bob did not investigate the area or alert facility security. He entered the building to begin his clinical duties.
II. Discovery and Outcome
The following morning, a local news report confirmed that a young man had been found deceased on the hospital grounds. The individual had been abandoned at the site during the previous night. The victim’s family has since signaled their intent to pursue legal action against Green Hills Medical Center, citing negligence and a failure to render aid by anyone present during the incident.
III. Critical Analysis Points
Identification of Emergency: To what extent should a healthcare professional be expected to investigate "suspicious" but non-visual cues on hospital property?
The Bystander Effect: Did the assumption that "someone else" would handle it—or that it was a routine occurrence—contribute to a lapse in judgment?
Legal Liability: Does a Patient Care Technician’s duty of care extend to the facility’s exterior perimeter before their shift officially commences?
Risk Management: Was there a failure in the hospital’s lighting or surveillance infrastructure that contributed to the victim remaining unnoticed?
Please read the case study above and answer the following questions. Ensure your answers are supported by at least two scholarly references, which you should cite properly in your response.
Additional Questions
1.What is the most ethical course of action for Bob to take in this situation?
2.Based on the principle of malpractice, could Bob be held legally responsible by the family?
3.Based on the principle of malpractice, could the hospital be held legally responsible by the family?
