Overview
I'm working on a business law discussion question and need an explanation and answer to help me learn.
I purchased a car via a private sale from a friend. Their dad was previously a car salesman who owned a car lot. After test driving, I had asked my friend and her father if there were any issues and the father replied, "No, it's in perfect working order. You should have no issues whatsoever. "
Money was exchanged, the pink slip signed over to me and I left feeling I had made a wise choice. Since it was a deal between friends, no physical contract was signed. I filled out the proper paperwork with the DMV when I registered the car in my name later that week.
A month later, the car stopped working. I called my friend and let them know I took the car in for repairs and asked them to pay for it since they had guaranteed the condition of the vehicle. Granted it was not new, it was 8 years old, and had an average amount of miles for that type of vehicle. They refused to honor their word of its condition and an argument ensued.
Was a contract legally formed or not that could be enforced?
