- Brief the article (specify Issue, Rule, Analysis, and Conclusion) and attach it to the post. Very briefly summarize the facts in a sentence or two (do not copy and paste the entire article into the discussion). The Analysis should incorporate the applicable information from our textbook with citations. The conclusion is YOUR conclusion on the outcome or pending outcome of the case.

8-7a. Theft and Embezzlement
The action of employees who take their employers’ property is theft or embezzlement. For theft, the following elements are necessary: (1) intent to take the property, (2) actual taking of the property for permanent use, and (3) no authorization to take the property. These three elements are the actus reus of the crime. The mens rea is the taking of the property with the intent of permanently depriving the owner of use and possession. For example, in the great ice-cream-licking YouTube sensation in the summer of 2019, defense lawyers used the actus reus issue to avoid theft charges for their clients. The lawyers argued that their clients opened ice cream containers in grocery stores, licked the ice cream, and then returned it to the freezer. They did not take the ice cream out of the store. Local police resorted to other charges because the action required for theft was not completed.
For embezzlement, the elements are the same as for theft, with the addition of one more element: the person commits the crime while in the employ or position of trust of the property owner. In other words, embezzlement is theft from a specific type of person—an employer. Although it is usually limited to funds, embezzlement can cover such items as inventory and equipment of a business.
