Refer to the Audio/Video Note Student Guide for assistance using the Record Audio function in Brightspace.

Here are the questions your listeners have sent in this week:

Click each of the items below for more information on this Assessment.

Listener #1:

“What, if any, are the circumstances under which society could exist or businesses could function without the law?”

Please explain your answer and be sure to use at least one source from the Walden Library or other scholarly academic sources to support your response. A typical response will be at least 225–300 words (3–4 paragraphs) in length.

Listener #2:

”What is the difference between a felony and misdemeanor? Specifically, can you help me to better understand:

  • The elements of felonies and misdemeanors.
  • A few (2-3) examples of each of these types of crimes.
  • The punishments typically associated with felonies versus misdemeanors”
A typical response will be 150–225 words (2–3 paragraphs) in length and include references to at least one source from the Walden Library or other scholarly academic source.

Listener #3:

“My neighbor, Jason Chapman, stole a vehicle from my other neighbor, Colette Dewhurst’s driveway. While he was driving the car down the road at an excessive rate of speed, Chapman ran into Raymond Miller’s appliance store window and caused extensive damage. I have the following questions:

  • Can Dewhurst and Miller bring a civil action against Jason Chapman?
  • Can the state take action against Jason Chapman?
  • What functions does the law serve in this case?”

Please explain your answers and be sure to use at least two sources from the Walden Library or other scholarly academic sources to support your answers. A typical response will be at least 300–375 words (4–5 paragraphs) in length.

Listener #4:

“I’m feeling confused about which source of law takes priority in different circumstances. Can you help me understand why one source of law takes priority over another? These are some of the situations I was hoping you could weigh in on:

  • The state statute conflicts with the common law of that state.
  • A federal statute conflicts with the U.S. Constitution.
  • A common-law decision in one state conflicts with the U.S. Constitution.
  • A federal statute conflicts with a state constitution.”

Please explain your answer as to which of the items listed in each pair takes precedence (or priority).”

Be sure to use at least one source from the Walden Library or other scholarly academic sources to support your answers for each set of conflicting items. A typical response will be at least 75 words (1 paragraph) in length per item, for a total of at least 300 words (4 paragraphs).

Listener #5:

“I am the administrator of a local hospital. A trial court has made a finding against my hospital due to the death of a patient during surgery. However, I believe the hospital should not be found guilty under the doctrine of res ipsa loquitur since the surgeon has also been found guilty of malpractice and negligent homicide. Can you walk me through the process I would follow to appeal the trial court’s finding against the hospital? Thanks so much.”

Please explain your answer and be sure to use at least two sources from the Walden Library or other scholarly academic sources to support your answers. A typical response will be at least 225–300 words (3–4 paragraphs) in length.

Listener #6:

“My sister is being accused of a breach of contract and will be participating in a trial. Whom can we expect will take part in the trial process and what roles will they play in her trial?”

Listener #7:

“From my own research, I am aware the Constitution specifies federal courts have exclusive jurisdiction over admiralty claims. My partner and I have a claim against Fun-Time Cruise Lines based out of Miami, Florida, for negligence of the cruise line. My partner sustained injuries because of the company’s negligence while we were taking a cruise to the Caribbean. We live in Seattle, Washington. Can we bring our claim in state court, or must we bring our claim in federal court? Which court or courts could be the trial court with jurisdiction over the claim?”

Please explain your answer and be sure to use at least two sources from the Walden Library or other scholarly academic sources to support your answers. A typical response will be at least 225–300 words (3–4 paragraphs) in length.
