Analyze the internationalization of U.S. cyber and intellectual property laws
The majority of modern-day cyber attacks are carried out by foreign cyber criminals beyond the reach of U.S. extradition or are state sponsored by U.S. adversaries like China, Russia, North Korea or Iran. U.S. government enterprises, its military complex, and private industries are under a constant barrage of cyber attacks. U.S. industries fall victim to intellectual property theft that significantly devalues their products and inventions. The U.S. government continues to initiate criminal investigations and bring indictments against foreign actors in spite of the challenges in extraditing and prosecuting them.
Your response MUST address the following questions:
- Are U.S. criminal prosecutions effective in deterring and punishing foreign cyber and intellectual property criminals?
- Should the U.S. launch its own cyber attacks against nation states or criminal organizations?
- What other foreign policy tools (i.e. sanctions, bilateral agreements) should the U.S. use to deter these crimes or obtain cooperation from its adversaries?
