Now please write a 2–3-page paper addressing the following topics (you can writeit as one paper, no need to break it out into separate questions and answers.
- In this video, the mediator demonstrates several best practices that lead to a constructive and structured mediation process. We have discussed many of those practices in class. Discuss what specific best practices the mediator has used, and how does each such practice contribute to the overall objective of the mediation?
- In any conflict situation, there is a mixture of facts and emotions at play. Based on this video, what did the mediator do right in balancing the facts and emotions offered by each party, and are there any ways that the mediator could have done a better job with this?
- Evaluate the ethical issues involved in this mediation. In what ways did the two disputing parties and the mediator act ethically, and in what ways did they not do so? Based on the analysis of power held by each of the three parties, what are the ways that this meeting could have turned into a miscarriage of ethics? What, if anything, did the mediator do to prevent that from happening?
- Finally, if you had been the mediator in this situation, what, if anything, would you have done differently? And why?
