Since Jane decided to light her business on fire for insurance money, then I believe Jane should be charged for the death of the Fireman. Even though it was unintentional for her to cause the fireman to fall from the roof, her action caused his death. By lighting a business on fire, she should have known that firemen would show up to put it out. She may not have known their steps, but their job is to put the fire out one way or another, and they have protocols to extinguish it. I believe that if a person has a bad intent it can lead to a chain of bad consequences.
My husband has told me before “No good deed goes unpunished”. Whether Jane intended to get the insurance money and pay off everyone she owes money to, in the end, a life was taken. Not to mention that Jane was using a deadly element, that could have spread into other buildings. Jane could have tried to sell the business instead which would have been a lot safer. Yes, she may not have received all the money she needed to pay everyone off, but with time and payments, she would have. The book used an example of D1 shooting at V but accidentally hitting D2. In that situation, a person is using a dead weapon that does not always hit the intended person and can usually penetrate and hit others.
If Jane had not lit the business on fire, and the fireman had still fallen from the roof and died, then I do not believe that she should be charged for his death. Jane would not have been the cause of the death since it was not intentional. In this situation, the man would have died from the type of job he had. Being a fireman is not a safe job and they are aware of the risks that come with it. Jane would have no reason for the man's death, nor would she have been planning on any insurance money in this situation.
