Mislaid is when a person intentionally places an item down and then forgets about it when leaving. Most items are considered lost when a person unintentionally misplaces the item or loses the item. When it comes to lost or misplaced items, I believe that it may matter on the item whether someone who finds it, should keep it or return it. Another thing that would depend is if the person who lost it can verify that the lost item belongs to them. Also, if the founder of the item has at least attempted to look for the owner of the item.
A mislaid item, such as a phone, tablet, ring, or wallet should be something that should be returned to the person who lost it. Those items should be easy to verify ownership by having the person unlock the electronic, the wallet should have an ID with it, and rings sometimes have serial numbers engraved which can be traced back to the owner, or the owner should have documentation that will have the same serial number engraved. But, let's say the mislaid item was a hat, sunglasses, pen, money, or even a stuffed animal. It may be harder to identify the owner of those items and not be able to return them. Kids tend to misplace toys, especially when they play with other kids. Now, imagine a child's stuffed animal that was given to them by a parent who passed away. That stuffed animal may have a sentimental value to them and I would hope for the founder to do the right thing and at least attempt to find the owner of it.
Lost property can be an animal, money falling out of the pocket, or a necklace that broke off without the owner noticing. Again, these items may be ok for a finder to keep depending on the effort to look for the owner or the value. When it comes to money in general, I think it is very difficult because anyone can see someone pick up money and then state it is theirs, unless they know the serial number on the dollar which would be ridiculous. When an animal gets lost there are a few things that I have seen working in the animal field. A pet should be microchipped due to pets running away. Now if a pet is microchipped it is easy for them to be traced back to the owner only if it is registered and the pet was reported lost. There have been cases where previous animals have been microchipped, never registered, or are registered to an old owner and never find their way back home. In cases like that, I would say that the finder has a choice of keeping the pet if they want, or sending it to the shelter waiting to see if the owners show up, and if they don’t then adopt the pet. With most items, lost or mislaid, I think that a finder should only keep the item if they attempt to find the owner because they never know the sentimental value the item may have to someone.
