Chapter 1 case question 4

Lance is a hacker who stole 15,000 credit card numbers and sold them to the black- market making millions. For this Lance will be facing civil and criminal lawsuits. “A civil action begins when a party to a dispute files a complaint and pays a filing fee required by statute” (United States courts para. 1). Lance’s civil case will be brought by the individuals that had their credit card information stolen. He is not the one that used their credit card information, but he is at fault because he stole the information and sold it to the black market. “A criminal case “Only the government initiates a criminal case, usually through the U.S. attorney’s office, in coordination with a law enforcement agency” (United States courts para. 1). The criminal case would need to be brought by the state. It is illegal to steal people’s identity, and information to make profit. Lance was wrong to hack and steal the information from these individuals and he will have to pay for the decisions that he made. The jury is going to decide in whether Lance is innocent or guilty. If found guilty he will most likely end up paying a monetary penalization to the individuals for the damages caused. Lance hacked 15,000 credit card numbers his payback is going to end up being large to compensate for what he has stolen from people. If Lance is found guilty of criminal charges, he will more than likely face prison time due to the theft of people’s credit card numbers.

Chapter 4 question 2

Carter was an employee of the Sheriff’s office in Hampton, Virginia. His boss is up for reelection against Adams. Carter liked a post on Facebook that was promoting Adams, which resulted in him being terminated from his job. Carter believed that he was fired for liking the post not promoting his boss, Sheriff Roberts. If this is the case Sheriff Roberts is in the wrong firing someone because of a like on Facebook not promoting yourself is petty. This is completely unprofessional on behalf of Sheriff Roberts; Carter has every right to like whatever he wants on Facebook. The first amendment guarantees the freedom of speech, press, and religion. Although the judge made a statement that liking a post can not be protected under the first amendment because it is not speech. It was not a post that Carter made but one that he liked so that is why it is not protected. I believe that social media posts should be protected under that first amendment because it is a way of communicating and getting an individual’s point across. If the post is not harming anyone or there is nothing premeditated in it, the post should be fine. We are in a growing age and social media has taken over so a law should be passed that protects people post under the first amendment. This overall is a tough case because Carter can argue he was fired because of a post and Sheriff Roberts can argue he fired Carter because of other reasons.

Chapter 5 question 4

Annie and Bart are coworkers, they were recently involved in a car accident. Each of them blames each other for the accident, how should they go about things? There are a few choices that Annie and Bart have arbitration is when an agreement is submitted by both parties to an arbitrator, they make the decision on the dispute. Mediation is when a third party is involved that assists the opposing parties in coming to an agreement through special negotiation techniques. A traditional lawsuit is when the problems are resolved by the court this in an expensive and lengthy route. The best choice for them to conclude would be arbitration. They can have an impartial person listen to them and come to conclusion on what needs to happen. This is the least traditional way, but it would work. Mediation would not work because they do not have common ground, they are not willing to come to an agreement on their own. They sit next to each other at work and do not speak. Traditional court would not work because they do not have enough evidence for the case. The judge would have nothing to go off so this would end up being a waste of time and money for both parties.
